Terms of Service

These Terms of Service (“Terms”) are an agreement between you and the developer of Keeps (“Keeps”, “we”, “us”) governing your use of the Keeps app and service. By creating or joining a film, or otherwise using Keeps, you agree to these Terms. If you do not agree, do not use the app.
1. The app licence
Your right to install and use the Keeps app is licensed, not sold, to you under Apple’s standard Licensed Application End User License Agreement (the “EULA”). These Terms add to the EULA and govern the Keeps service — films, photo sharing, storage, and purchases. If the EULA and these Terms conflict for matters the EULA covers, the EULA controls; for the service, these Terms control.
2. Eligibility
You must be at least 13 years old, or the minimum age of digital consent in your country (up to 16 in parts of the EU), to use Keeps. If you are under the age of majority where you live, you may use Keeps only with the involvement of a parent or guardian who accepts these Terms.
3. Your account
You can use Keeps as a guest or with a full account (Sign in with Apple or Google). You are responsible for activity under your account and for keeping access to it secure. Provide accurate information and do not impersonate others or use another person’s account without permission.
4. The service
Keeps lets you create a shared “film”, invite others, and capture photos together. Photos may be hidden until a reveal moment and are then visible to the members of that film. Features, limits, and plans may change over time as we develop the service.
5. Your content and ownership
You keep ownership of the photos and other content you create or upload (“Your Content”). We do not claim ownership of it. You are responsible for Your Content and for having the rights necessary to share it.
6. Licence you grant to us
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, and display Your Content solely to operate, secure, and improve the service — for example to store photos, generate covers and thumbnails, and deliver them to the members of your film. This licence is not for advertising and we do not sell Your Content. It ends when you delete Your Content or your account, except for copies retained briefly in backups or as required by law.
7. Licence you grant to other members
When you add photos to a film, you grant the other members of that film the right to view and save those photos through the app. This sharing is the core purpose of Keeps. Only add photos to a film if you are comfortable with its members keeping their own copies. We cannot control what members do with photos once they have saved them.
8. Your responsibilities
By using Keeps you represent that:
- you own Your Content or have all rights and permissions needed to share it;
- you have the consent of people who are identifiable in your photos to capture and share those photos with a film’s members;
- Your Content does not infringe anyone’s rights or break any law.
9. Acceptable use
We operate Keeps with zero tolerance for objectionable content and abusive behaviour. You must not upload, share, or use Keeps for content or conduct that:
- is illegal, or sexualises or exploits minors in any way;
- is non-consensual intimate imagery, harassing, hateful, threatening, or invades others’ privacy;
- infringes intellectual-property or other rights;
- contains malware, or attempts to disrupt, reverse-engineer, or gain unauthorised access to the service.
10. Event host responsibility and removal
Keeps is a private event-photo service, not a public social network. Event Hosts are responsible for deciding who to invite and for managing their event. Hosts may remove a participant, which removes that participant's photos from the event and prevents them from rejoining, or delete the entire event. If you believe content infringes your rights or is unlawful, contact us using the details below. We may act where required by law.
11. Purchases and plans
Keeps offers optional purchases, such as additional guest capacity, sold as one-time (consumable) items. Purchases are processed by Apple through your App Store account and are subject to the App Store’s terms; billing, taxes, and refunds are handled by Apple. Because these items are digital content made available immediately, they are generally non-refundable once used, except where a refund is required by Apple’s policy or by applicable law. Your mandatory statutory consumer rights are not affected.
12. Content retention and deletion
Photos are stored for the period tied to a film’s plan — approximately 30 days on the free tier and up to 1 year on paid films — after which they may be deleted. You can delete your account from within the app, which removes your account data and associated content, subject to short-lived backups and legal retention. 13. Termination
You may stop using Keeps and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the service or its users. Provisions that by their nature should survive termination — such as content licences already granted to members, disclaimers, and limitations of liability — will survive.
14. Disclaimers
Keeps is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free, or that content will never be lost. Keep your own copies of photos that matter to you.
15. Limitation of liability
To the fullest extent permitted by law, Keeps will not be liable for indirect, incidental, or consequential damages, or for loss of data or content, arising from your use of the service. Nothing in these Terms limits liability that cannot be limited by law, including your mandatory rights as a consumer.
16. Indemnity
You agree to indemnify us against claims and costs arising from Your Content or from your breach of these Terms, to the extent permitted by law.
17. Changes to these Terms
We may update these Terms to reflect changes to the service or the law. We will post the updated Terms here with a revised “Last updated” date and, where appropriate, notify you in the app. Continuing to use Keeps after changes take effect means you accept them.
18. Governing law and disputes
These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-laws rules. If you are a consumer, you also keep the protection of any mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts where the law allows. Consumers in the EU may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
